Surface Water Protection Working Group
The Comprehensive Plan requires the regulation of development along surface waters to include the Indian River Lagoon system and the St. Johns river to protect the public health, safety and welfare of the citizens of Brevard County. This is accomplished by protecting water quality and promoting a healthy ecosystem, which in turn provides both economic and recreational opportunities for the community.
Over the last several years, numerous requests to clarify the Surface Water Protection code (Chapter 62, Article X, Division 3) have arisen. On April 22, 2008, the Brevard County Board of County Commissioners approved the formation of a Working Group to review the Surface Water Protection regulations and make recommendations for improvement. On May 20, 2008, the Board adopted Resolution 08-110, creating the Stakeholder Working Group.

This is a draft ordinance prepared by the Brevard County Zoning Department. The Planning & Zoning and County Commission Boards will conduct public hearings prior to adoption. The ordinance may pass as-is or may have significant changes.

- U.S. Army Corps of Engineers (ACOE) Nationwide Permits
There are 50 Nationwide permits listed on the ACOE website (see “ACOE Nationwide Permit Summaries” below). Sixteen of these appear to have some relevance to the surface water ordinance and are also posted below. Due to the abundant amount of information, staff has not printed each of these documents for the Working Group. However, we will be happy to print any documents you would like for your binder. Please email darcie.mcgee@brevardcounty.us to request printed documents. If the Group decides that all documents are needed hard-copy, we will be happy to print them for you.
